What we will do for you in purchasing your property

Obtain your instructions on the sale and any mortgagee on title and chosen Agent
Attend to ordering title searches from Dept of Lands,
Attend to ordering zoning certificate from local Council authority
Attend to ordering sewerage diagram from Water authority
Review folio certificates for Lot and Deposited Plan (if house)
Review folios for Lot and Common Property and Strata Plan (if strata unit/townhouse)
Obtain any documents creating or purporting to create an easement, profit à prendré, or restriction on use, or positive covenant
Review zoning certificate under Environmental Planning and Assessment Act 1979
Review drainage diagram for connections
Ensure compliance with smoke alarm statement requirements
Review and advise on any existing survey and building certificate (if supplied)
Review lease arrangements (if applicable)
Liaise with letting agent regarding lease and rent status (if applicable)
Liaise with you regarding contract terms and conditions
Prepare draft contract, including special conditions and annexures
Ensure contract complies with the Vendor Disclosure legislation
Advise vendor with respect to draft contract
Advise on CGT, GST and Land Tax implications of proposed transaction
Liaise with real estate agent regarding contract terms and inclusions
Forward draft contract to real estate agent for marketing
Forward Contracts to Agent for Auction (if applicable)
Receive Agent’s sales advice and confirm with vendor
Liaise with purchaser’s solicitor
Advise on any requested amendments with vendor
Negotiate with purchaser’s solicitor with respect to amendments to contract
Arrange exchange of contract with purchaser’s solicitor
Attend on exchange of contracts (unless at auction)
Forward deposit cheque to agent, or bank into Trust/Controlled Money account
Liaise with you regarding discharging mortgage (if applicable)
Liaise with bank regarding intention to discharge mortgage
Arrange for provision of s109 certificate from Strata Managers (if strata title)
Review requisitions on title
Liaise with you regarding replying to requisitions on title
Replying to requisitions on title
Arrange for payment of Land Tax (if necessary)
Liaising with purchaser’s solicitor regarding early possession (if necessary),
Negotiating terms of license agreement
drafting Occupation Licence Agreement (if necessary)
Liaise with you and arrange for signing of any necessary documentation
Review Settlement figures provided by purchaser’s solicitor
Check balance updates with local authorities and Strata Manager for settlement figures
Arrange settlement time and venue
Confirm settlement arrangements with bank
Obtain mortgage payout figure from bank
Liaise with you confirming cheque requirements
Draft cheque directions
Advise purchasers solicitor of cheque directions
Liaise with letting agent (if applicable)
draft Notice of Attornment (if applicable)
Arrange to obtain title documents and arrange with Agent keys for property
Ensure vacant possession (if applicable)
Advise vendor on cancellation of services
Re-schedule settlement (if necessary),
Liaise with bank for new mortgage payout figure
Re-draft cheque directions,
Liaise with vendor regarding re-scheduled settlement
Arrange for settlement attendance and review settlement documents
Arrange for banking of cheques (if necessary)
Notify you and Agent of settlement
Forward Order on agent to release deposit and keys
Liaise with you and the Agent accounting for deposit held
Liaise with Letting Agent (if necessary)
Forward cheques as necessary
Report to you and forward copy documents for tax record keeping purposes
